These terms govern the use of website design and related services provided by JMS Web Design (ABN 79 773 473 522). By engaging our services, you agree to these terms.
Services
JMS Web Design provides one-page website builds, domain setup assistance, hosting setup, and custom business email configuration. Full details of each package are outlined on our pricing page.
Pricing and Payment
- Full Setup Package: $349 upfront setup fee, then $49 per month (6-month minimum term). Includes website build, domain registration, hosting, business email, and ongoing updates.
- Build-Only Package: One-off build fee as quoted. Does not include domain registration, hosting, or ongoing updates.
- All prices are in Australian dollars (AUD) and include GST where applicable.
- Payment is due within 14 days of invoice date unless otherwise agreed.
Client Responsibilities
- Provide accurate business information, wording, images and branding in a timely manner
- Respond to requests for feedback or approval within a reasonable timeframe
- Ensure you have the right to use any content or images you provide
- Maintain the confidentiality of any login credentials provided
Project Timelines
Timelines depend on the complexity of the project and timely provision of content by the client. We will communicate expected timeframes during the initial discussion.
Intellectual Property
Upon full payment, the client owns the website design and content created specifically for them. JMS Web Design retains the right to display completed work in its portfolio unless otherwise agreed.
Hosting and Domain
Domain registration and hosting are arranged on your behalf as part of the Full Setup Package. You are the registered owner of the domain. Ongoing hosting fees are included in the monthly plan for the duration of the agreement.
Cancellation
- Full Setup Package: May be cancelled after the initial 6-month minimum term with 14 days written notice. Upon cancellation, you retain ownership of the domain and website files.
- Build-Only Package: No ongoing commitment beyond the one-off build fee.
Limitation of Liability
JMS Web Design provides websites and services on an "as is" basis. We are not liable for any indirect, incidental or consequential damages arising from the use of our services. Our total liability is limited to the amount paid for the specific service giving rise to the claim.
Privacy
Our Privacy Policy explains how we handle your personal information.
Changes to These Terms
We may update these terms from time to time. Clients will be notified of any material changes.
